前几年陪着一个朋友去咨询过律师避难的问题，朋友是lgbt人士，认为国内对他来说无法生存，于是找了律师商量自己的情况是否可以避难。

拿我朋友的lgbt案例来说，尽管我们都知道lgbt在国内处境困难，但我在旁边旁听的结果就是，美国的避难绿卡对于他的case却很难做。这个避难绿卡申请，一定要有完整的逻辑和证据链，证明“当事人回国就会被国家政府公权力迫害”，以及“国家政府是否无法保护你免于这些迫害”。

在这两点上，我的朋友就是死活无法证明。因为一来中国的确没有系统性的法律迫害lgbt（相反lgbt在2000年初还被除罪除病化了）。二来如果他在国内因为性取向被打，法律是会判打人者有罪的（公权力会保护免于迫害）。

当时律师给他举了两个例子，一个例子是计划生育。这是个妥妥写在法律里的迫害政策，满足了第一条。而且计划生育期间，政府公权力亲自下场强行打胎和罚款，随便一条证据就满足了第二条。所以计划生育曾经是非常流行的避难理由。另一个例子则是伊朗的lgbt人士。由于伊朗有法律阶层的反同，所以两条也轻易满足。

另外我没记错的话，美国避难申请必须在登陆美国一年内提交，不然必须证明国内有针对你的重要政策变化导致了你当年不交现在才交。

总之我那位朋友最终没有考虑避难绿卡，因为这个要求并不是简单的“撕了护照”或者“国内过的不爽”就行的。“撕了护照”那属于黑下来，不属于避难的必要环节。

加拿大不太清楚，但美国这边chinatown里遍地避难移民。不是在避难的过程中，就是通过避难拿了绿卡。拿计划生育为理由的人非常多
