昨天看到这个，这哥们曾经在美国上本科，然后回国了。之后觉得国内环境不好，又想润美。签证三次，全没过。第一次是B签和F签一起上，自然是全被拒。在VO看来，既然你都要来上学了，为什么还要先申请来旅游呢？要知道，读书你可以提前一个月入境的。只能说明你太想跑了。第二次申请数学专业硕士的F签,可能是因为有被拒记录，再次被拒。 最后不得不走线。先办理了申根区签证，转飞墨西哥。之后游泳进入美国。自称护照丢了。向移民局自首，然后被转到移民拘留所，之后是移民监狱。最后释放。 比较讽刺地是，作为在美国上过本科的人，居然不懂M444是什么。即便你原来不知道，你在进来之前也该上网google一下子。就是说，偷渡者入境，属于非法。会被放入到遣返程序之内，你必须申请可信恐惧面谈，才能避免被快速遣返。如果通过，会转入移民法庭，由法官决定你是否获得庇护；如果不通过，还是要启动遣返程序。他所说的丢护照，很可能也是基于这个原因。偷渡客有不少是直接撕掉护照的。这样可以极大地拖延遣返的时间。因为中国这边对于遣返回国不怎么配合，发旅行证非常慢。 还有一个值得说的，就是22年5月31日后入境的偷渡者，会适用于新的程序，Asylum Merit Interview，简称AMI。该程序是在恐惧面谈通过后，给一次类似于一般庇护的面谈机会，如果通过，直接获得庇护身份；如果不通过，可能会被放入到遣返程序中，没有上法庭申辩的机会。这是那些天天嚷嚷着走线的人，没有人提过的。 AMI只适用于单身的成年偷渡者，这老兄大概率就是AMI.他竟然还以为自己可以走主动庇护！真不知道他这美本读到哪里去了？ 走线有风险，谨慎选择。如果非要选这条路，请把所有的后果都了解清楚。

1，是你是否提供给移民局。你提供了，那么你的可信度就会更高。当然，这哥们没说自己把护照给撕了，他说他把护照放在包里，站在墨西哥一侧向美国那边扔，结果挂在了铁丝网上，取不下来了。人家移民局只看你是否提供，你不提供，那想通过就更难呗。2,这个问题真的没法准确地回答你，因为我也不是移民官，即便是移民官，他们也不许随便透露内部的工作规程。只能讲一下个人了解的规律：容易程度：主动庇护比被动庇护容易；移民局面谈与法庭辩论，哪个容易，不好说。取决于你遇到的人是谁。他这个AMI,肯定是不如正规签证进来之后申请主动庇护，那样即便面谈没过，还有法庭，至少有10年+的时间。

法庭事先就知道法官是谁，移民局不知道移民官是谁。在纽约、旧金山这种地方，法官通过率高的可达 80% 以上。所以如果地点选对了，又碰上好法官，法庭更容易。

谁告诉你的，你知道2020年的时候拒绝率高到吓人，超过30%拒绝。就是面谈以后直接递解了。根本没上法庭的机会。你说的那是20年以前，确实拒绝的是极个别。大部分有打庭的机会。请在行动前多了解行情，别像这哥们一样，都被抓了，还天真地以为自己可以像有签证的人一样做affirmative asylum。一只脚已经快伸进太平洋了。可称之为迷之自信。

拜托，怎么可能？就算你是主动庇护，现在也要等很久才面谈。他8月份才偷渡进美国。这孩子比张晓宁强点有限。你如果听过张晓宁和人对话的录音，还有她杀完人之后的喊的口号，真的会怀疑她就是精神失常。这个男的接受过洛奇和大纪元的采访，恐怕就是打算给自己凑素材吧？
