留学可以的呀，又不是黑下来，身份F1只要是有效的状态是可以申请，两个系统是独立的，申请h1b的过程中申请asylum是允许的，同理只要F1签证有效反过来也适用。

一个人可以同时是 I-589 Pending 和 F1 ，也可以是 I-589 Pending 和 H1B 。

你说的互斥有道理，互斥指的是申请了移民之后，离开美国，再续签非移民签证，签不下来。申请庇护便没有了 F1 就是这种情况。

对。就是死了。你申请了，要么过了。那你自然不必再申请H1b了。你如果F1身份，没过面谈。你有两个选择：1放弃，继续读书。读完书以后再靠别的办法。2继续，你的案子会被转到法庭，当然，你的合法身份也就没了。你怎么可能还能抽h1b呢？h1b的前提，是你一直有合法身份。所以，你说的这种情况是不存在的。因为所有上了移民法庭的人，其NTA上都有一条，丧失了合法身份。这是移民局对你的charge。你要抗诉。所以，你说的那种既保持合法身份，又一边打庇护官司，是不可能的。

庇护面谈失败F1有效情况下似乎是可以转F1回去的，然后该怎么样怎么样（不太确定，个人理解），问题是首先你说落地庇护是真的受过迫害吗，如果是的话其实根本无需考虑后面的，我相信真正的迫害无论怎么样都会过的，没有的话那就已经造假了。还有就是即使回了F1庇护已经表达了移民倾向，未来在H1以前不能出美国了，要不然很可能回不来因为F1入境是不能有移民倾向的，h1除了non-profit现在最近的中的概率20%，真别以为读了个phd美国就必须留你。qs 800大学应该不太可能是非常有钱的学校，读书过个niw应该没有问题，但是找教职和排名有关，你这个学校加上基础学科的特性你找不到教职的，你只能找postdoc，然后postdoc很多学校不担保H1只担保J1，你就可能要去中国使馆申请新护照因为非常非常长的Eb2排期，你庇护的事情中国领馆倒是不会知道，但是你绿卡面试的时候面试官可能会问你，因为庇护了按理你就对中国有恐惧，你怎么还申请中国护照呢？哦，还有J1是要办豁免的，要不然得回中国工作两年，且如果你去第三国是不算在两年里面的………楼主自己想好吧

是的，那个1175高度怀疑是某些无良中介的账号。他对于庇护的基本常识是不清楚的。合法身份B1/2, F1或H1，如果你在身份合法期间庇护面谈失败，要么选择继续打下去，失去合法身份上法庭，当然你也就不能再走职业移民了，只能是庇护一条道走到黑；要么你放弃庇护，再回到合法身份。但对你以后有什么影响，不好说。比如你回国换H1B签证，很可能会因为你曾经申请庇护有移民倾向而拒签。庇护这个事，有风险。肯定不是像这个人说得可以随便申请。反正听了他的，他也不会对你负责。很多人都是在盲目动作中把自己给害了。
