我看本sub里有几篇讨论美国庇护的thread，其中有合理的说法，也有许多误区。我在这里结合自己的经验说几点，希望能帮助到有需要的人。

另外我建议moderator把那个自动检测“庇护”关键词的bot关掉，这简直是在troll。 bot回复的那些什么转发500群自动获得庇护的东西完全没有节目效果。

我多年前早已拿到庇护，和好几个律师打过交道。我在这里尽量做到简短精到。

  1. 一年的bar。误区：必须落地一年内递交589 。实际情况：一年bar是指在【最后一次进入美国后一年内】递交，【并且】维持非移民身份期间不计入一年期限，也就是说，不管你是读书F1还是工作H1B，只要你维持【合法身份】，即使在美国二十年，你仍然可以申请庇护，当然，你需要在合法身份过期的【一年内】申请。
  2. 大部分庇护都是“假庇护”。误区：真被迫害的人出不来，出来的人没被迫害过，所以大部分为假案子。实际情况：移民和国籍法案（INA）对于庇护的界定并不是普通人想当然的那种标准。例如，你不需要过去被迫害过，仅仅基于【对未来的合理恐惧】就可以获得庇护。对未来的合理恐惧如何界定？请自行搜索 【mogharrabi test】。总的来说，美国INA法案保护的是【有可能】受到迫害的人，而不是【已经】受到过迫害的人。【已经受到过迫害】的人会享有【rebuttable presumption of well-founded future persecution】。也就是说，这些人只是被【假定】未来仍会受到迫害，且这种假定是可被反驳的。说到底还是要归结到【未来】【有可能】受到迫害。所以不要觉得在中国没被迫害过就是假案子，也不要看不起轮子和举牌子的，人家干的事完全合法，您觉得假那是您不懂法。当然，连牌子都不举空口编的那种是妥妥的假案子没问题。
  3. 我被强拆了/被强奸了/被警察打了/被拘留了，所以我的庇护就能成功。误区：在中国稍微遭点罪就以为可以成功庇护。实际情况：庇护有他的一套章法，您踩到点上就不费劲，踩不到点上就很费劲。庇护的成功要点我总结为以下四点，【Why】【Who】【How】【Relocation】。【Why】：你为什么有可能被迫害。这个理由必须是五个受保护的理由之一。拆迁之类的经济纠纷，或者被强奸这类的刑事案件，他们【单独】并不构成受到庇护的要件。你得往宗教和政治理由上靠。【Who】：谁要迫害你。迫害者必须是【政府】或者【政府不能控制（南美黑帮这种）或不愿意控制的人（平子）】。如果是政府人员打你了，那要看是因为与你的私仇，还是因为你的政治观点？【How】：这一点下面又有两个小点。【1.政府怎么知道你的存在（您贵姓大名？）】【2.政府怎么会对你有兴趣（您算老几？）】。也就是说，您得高调亮相，戴个口罩去举牌子没啥用。最后一点，【Relocation】。您搞事也搞了，您家里人也被问候了，但是！您如果从中国东北搬家到西南，能不能躲避迫害？您得证明不能。怎么证明？那您和律师好好商量去。

庇护这事既难也不难。难就难在你把我上面提到的点都覆盖到，不难地方就在于这些点都是公开的。美国的移民和国籍法案对真正需要庇护的人可以说，门槛是比较低的，但是对没有经历的人门槛却是很高的。

移民法里对义人提供的保护的门槛可以说是在地板上，但仍然是大多数人达不到天花板。

讽刺的是，大多数人心里对义人的门槛是在天花板上（你都没蹲过监狱？哼，假庇护。），自己的行动却在地下室水平（上推特只敢点赞）。

是这样的，对于一个知法懂法的中国人以符合真实性的前提下把庇护所有的点都覆盖到，最终留下来不难。对于普通中国人来到美国首先就是安排好自己的庇护案件，然后再在美国学习工作生活

这才是对的，理论上你是LGBTQ不能申请，因为没有法律写了禁止LGBTQ，但是你支持LGBTQ去游行然后被公安抓到警局里喝茶，那你就是符合申请条件了，因为中国宪法是说可以合法游行集会的自由（只是是个中国人就知道是个笑话）。但是对于美国人而言，你经历的很多事对他们都是天方夜谭的，比如你从北方逃到南方为啥还会被迫害，你把国内天网系统一套和维吾尔人全国开房要被警察上门查的事情一证明，这还能不稳？

感谢润友 runlaohigh 的分享，这是一篇很有价值的帖子，对于想要申请庇护的润友来说，可以作为一个参考。我想补充一点，就是庇护的成功率也和你选择的律师有关，不同的律师有不同的经验和水平，有的律师可能会帮你准备好所有的材料和证据，有的律师可能只是随便敷衍一下。所以在选择律师的时候，一定要慎重，最好找一些有口碑和成功案例的律师，不要贪图便宜，也不要轻信广告。如果有条件的话，可以咨询一下已经拿到庇护的润友，看看他们是怎么找到律师的，有没有什么推荐或者避雷的建议。当然，最重要的还是自己的案子要有说服力，要符合庇护的要求，不要编造或夸大事实，要有真实的证据和理由。希望所有想要庇护的润友都能成功，早日摆脱共匪的迫害，享受自由的生活。鸭鸭祝福你们！
