只要好好报税，就一定会庇护成功？

最近在版上看到一个说法，就是只要你有好好报税，就一定会庇护成功。 必须提醒版上在走线或者已经走完线的，这种说法没有任何的法律依据。

这个说法也不能算全错，报税对庇护成功率一定是有正面影响的。 首先，他会让法官认为你是一个诚实守法的人，不会用这个部分为难你。 其次，确实有法官有帮助纳税庇护者的倾向，但是这并不是法律规定，而是法官个人倾向，所以没有任何的guarantee。

回到这个说法本身，“只要你好好报税，就一定会庇护成功“，这个说法在英文世界你找不到任何来源，只在中文世界中广为流传。 就算这是个在英文世界也被公认的事情，也不是写进法律条文的东西。当然你可以说，这是一种约定俗成，但只要不是写进法律条文的东西，就意味着不是所有人都会遵守。也会随着法官的变迁而导致不再“约定俗成”。

中国人的庇护成功率高，本质上还是来自独裁国家导致的优势。

话又说回来，老中选择庇护情有可原，或多或少底层中国人都是共产党的受害者。觉得自己受到庇护就大胆申请吧，中国人的庇护率确实高。

这个说法有点像著名的90天规则myth。 给不知道的朋友们说一下，90天规则是国务院用来指导大使馆的规则，实际上在移民局从来没有正式被启用过。

但是在英文世界和中文世界有无数的人相信90天规则，即使已经有无数的实例能够反驳。这个东西甚至连约定俗成都不算。

我一时间还能想到的迷思包括但不限于：

1.生了公民小孩可以帮助我的职业绿卡面试

2.有小孩的人不会被遣返令/壁虎面谈一定过

3.由公民小孩的不会被下遣返令

（下遣返令和遣返是两回事）

移民法因为繁琐且笨重，相关的东西有很多的迷思，在讨论这些东西的时候，还是多加查找法律原文为好。

如果找不到原文，那就最多只是约定俗成。只要最多只是约定俗称，就多留个心眼。

这个版块我唯一骂过的庇护人士就是tivel8571（曾用id frankie_xjp） 顺便一提这个版块的水平确实是肉眼可见的幽默，比如那个tivel8571 前阵子私信说我吐槽他庇护成功率低，追着我疯狂攻击，还说自己有好几个公民女备胎，根本不屑庇护

过不过就在面谈官/法官的一念之间（他们的权利就是这么大）。那你觉得一个有全部纳税记录的人通过率高，还是一个月月领低保的通过率高？纳税是在美国生活的基础，何况你一个来寻求保护的外国人，收留你并不是美国政府的义务，是没有把这个要求写进法律里，但你拿了工卡不报税你试试看？除非你只想赚够了钱就回国

法官一般会考虑你和当地的connecting情况，包税，教会，参加NGO公益活动都是考虑的一部分，和当地联系不大，法官肯定认为不会长期居住

那为啥民主的印度竟然庇护通过率百分之60%了，说白了就是吸纳移民的一种手段罢了。你要知道有些纽约的法官庇护通过率百分之90%​。
