并且只要在失去合法身份前批准niw的140 只要赶到庇护面谈之前即使丢了合法身份依然可以交485 两条路不冲突

magspge· ↗严格意义上来说面谈前的i589 pending是合法状态但不是合法签证身份。移民局规定没有签证身份不能交485用来身份转换 但庇护的特殊之处就在于i589 pending期间即使失去签证身份、使用了C8工卡也会被判为移民法本身的流程错误 你依然可以被豁免、可以申请递交485。
但是如果你真走到NIW 485那一步 你NIW的485会被i589 pending挡住 你需要手动撤回你589案子 你NIW 485的时候大概率会被问到撤589案子这回事的 这才是有消极影响这种说法的原因 至于影响多大全看你485的面试官 一般来说能过
