《中华人民共和国宪法》第三十二条第二款规定：中华人民共和国对于因为政治原因要求避难的外国人，可以给予受庇护的权利。1979年，越南国会副主席黄文欢是目前为止最后一个获得中国的政治庇护的外国人。从1980年代至今，没有任何外国人获得过中国的政治庇护。而到目前为止，曾经获得过中国的政治庇护的外国人都是外国亲共的政治领袖。
